Considering that the investigation carried out in France had been incomplete. that its rights had not been respected, Sand Van Roy decided to bring the case before the European Court of Human Rights (ECHR). According to Mediapart. “the request filed in October 2023 passed the difficult first filter of the European Court, paving the way for an examination of this file by the judges”.

The ECHR only retains about 10 % of the requests subject to it in this type of business. It can. if no amicable resolution is found, condemn a state for breach of its obligations in terms of respect for fundamental rights.

Towards an amicable resolution or legal proceedings

The case could now be resolved amicably by October 13, 2025, with a possible compensation proposal. In the absence of agreement on this date, legal proceedings will be opened.

Also according to Mediapart, Sand Van Roy believes that “only a condemnation of the French state could provide moral reparation”.
