AUSTIN. Therefore, Texas — A southeast Austin couple is suing the city and Austin Police Department officers and supervisors over a SWAT operation that they say left their home with thousands of dollars’ worth of damage.
The August 2023 operation on Channel Island Drive involved their neighbor, Dwayne Brzozowski. Therefore, At the time, police were conducting a welfare check and say Brzozowski opened fire, so officers ran for cover.
In a new lawsuit filed in federal court. Glen and Mindy Shield – who own the home across the street – say an officer hid in their garage during the shootout. The Shields say they didn’t austin couple sues city over know the person in their garage was a police officer.
When they went to see who it was, they say another officer threatened to kill them. They said they were detained for hours, despite having nothing to do with what was going on with their neighbor.
In the lawsuit. they also claim officers “methodically ransacked” their home, destroying their front door and walls and rupturing a gas line during the standoff.
The shields filed a claim with the city to get $23,000 for repairs, but the city denied their claim.
“Texas state law provides immunity from liability for property damage to local governments that engage in law enforcement. public safety functions, such as the Austin Police Department carried out in this case,” the city told the Shields at the time.

In a statement. a city spokesperson told KVUE the city hasn’t been served with the lawsuit yet but “will review it and respond appropriately.”
